Terms of Service
Last updated:
These Terms explain how MegaScenes works, what you can expect from us and what we expect from you. We have kept them short and plain. Where the law in your country gives you more rights, those rights apply.
01Who we are
MegaScenes is operated by SIDEK GROUP DIGITAL LLC, a limited liability company registered in Wyoming, USA. Our address is 5830 E 2nd St, Ste 7000, Casper, WY 82609, USA. You can reach us at support@example.com.
In these Terms, “we”, “us” and “our” mean SIDEK GROUP DIGITAL LLC. “You” means the person who uses MegaScenes. When you buy credits or a subscription, your contract is with SIDEK GROUP DIGITAL LLC.
These Terms, together with our Privacy Policy, Refund Policy and Acceptable Use Policy, are the agreement between you and us. By creating an account or using MegaScenes, you accept them. If you do not accept them, please do not use MegaScenes.
02What the service does
MegaScenes lets you generate video, images and audio with AI models made by other companies, including Google (Veo, Nano Banana), Kuaishou (Kling), ByteDance (Seedance, Seedream), Alibaba (Wan), MiniMax (Hailuo), OpenAI (GPT Image), Black Forest Labs (FLUX) and ElevenLabs. We run these models through inference providers, currently fal.ai.
MegaScenes is independent. We are not affiliated with, endorsed by or sponsored by the companies that make these models. Model names are trademarks of their owners and we use them only to tell you which model you are using.
The list of models changes over time. We may add, update or retire a model, and a model can be unavailable for a while if its maker or our provider has a problem. Your credits are not tied to a single model, so they stay usable with the other models.
AI models are unpredictable. An output can be inaccurate, different from what you asked for, or similar to outputs generated for other people. Check outputs before you rely on them or publish them.
03Your account
You must be at least 18 years old to use MegaScenes.
You can sign up with an email address and password or with your Google account. Give us accurate information and keep your login details private. You are responsible for what happens in your account. If you think someone else has accessed it, write to us at support@example.com straight away.
Accounts are personal. Do not share your account with other people, and do not sell or rent access to it.
04Credits
Generations are paid with credits. One credit equals US$0.01 of generation at our list prices. Before every generation starts, we show its price in credits.
- Unused credits roll over. Credits do not reset at the end of a billing period: while your subscription is active, unused credits stay in your balance and new ones are added on top. If you cancel, the credits you paid for stay usable for 12 months after your last paid period ends; after that they expire. If you subscribe again before they expire, they are added to your new plan.
- Failed generations are refunded in credits automatically. If a generation fails, times out, or the provider blocks the output, the credits go back to your balance. You can see every charge and every refund in your credit history.
- Credits are not money. They have no cash value, you cannot transfer them to another account, and we do not exchange them for cash, except as set out in our Refund Policy or where the law requires it.
- Credits we give you without a payment, for example in a promotion, are a courtesy. We may withdraw them.
- If a payment is refunded, or a dispute about it is decided against us, we remove the credits that payment added, in proportion to the amount refunded or reversed, up to the credits left in your balance. Your balance never goes below zero, and we do not ask you to pay back credits you already used.
05Prices, payments and taxes
Prices are in US dollars and do not include tax. Where sales tax or VAT applies, it is calculated at checkout and shown before you pay. In the United States, the EU and the UK, Whop collects that tax and pays it to the tax authorities. Your bank may charge its own currency conversion fees.
Payments are processed by Whop, Inc. Whop runs the checkout, handles your payment details and appears on your card statement as the payment processor. Whop acts as merchant of record only for card network rules, payment settlement and, where it collects and remits it, sales tax or VAT. For everything else, including the service itself, your consumer rights and refunds, the seller is SIDEK GROUP DIGITAL LLC. Whop’s Buyer Terms also apply to the payment.
Subscriptions are monthly unless the checkout clearly says the plan is annual. A subscription renews automatically at the end of each billing period until you cancel. What each plan includes is shown on the pricing page and at checkout.
First week for $1. New accounts can start any plan with a first period of 7 days for $1, which comes with 150 credits. Unless you cancel before those 7days end, the plan then renews at its monthly price and every month after that, and you get the plan’s monthly credits on top of what is left. Before you pay, the checkout shows the price of the first week and what the plan costs after it. One first week per person: if the payment provider finds you already had one, the checkout charges the plan’s monthly price together with the first-week price, and you get credits for the full amount you paid.
To stop abuse, the first week is not offered to disposable email addresses, to a connection that has already started several first weeks in the last 24 hours, or when an unusual number of first weeks start at the same time; the plan at its full price stays available. If the card you pay with has already been used for a first week on another account, we cancel the new plan and refund the first-week payment instead of adding the credits.
If we change the price of your subscription, we tell you by email at least 30 days before the new price applies. You can cancel before then.
If a renewal payment fails, Whop may try it again. If it stays unpaid, your subscription ends. The paid credits you already have stay on your account.
06Cancelling a subscription
You can cancel at any time, in one click, from the Billing page of your account. We do not ask you to call us, fill in a survey or go through retention offers.
Cancelling stops future renewals. Your plan stays active until the end of the period you already paid for, and your paid credits stay on your account after that. Refunds are covered by our Refund Policy.
07Your content and your outputs
“Inputs” are the prompts, images, videos, audio and other files you submit. “Outputs” are the files the models generate for you.
Inputs. You keep the rights you have in your inputs. You confirm that you have all the rights, licences and permissions needed to submit them, including the consent of any real person who appears in them or whose voice you use.
Outputs. You keep whatever rights in your outputs the law and the terms of the model’s maker give you. We do not claim ownership of your outputs. In some countries AI-generated material may not be protected by copyright, and a model can generate similar outputs for other people, so we cannot promise that an output is unique or that you hold exclusive rights in it. Your use of outputs must also follow the usage policies of the model’s maker.
What you allow us to do. You give us a worldwide, non-exclusive, royalty-free licence to host, store, copy, process, transmit and display your inputs and outputs, only as needed to provide MegaScenes to you. This includes sending your request to the model, saving the result, showing it to you and running the safety checks described in our Acceptable Use Policy. The licence ends when you delete the content or close your account, except for copies we must keep by law. We keep no backup copies of your uploaded or generated files. Database backups, which can contain your prompts, are deleted automatically within 30 days.
No training. We do not use your prompts, inputs or outputs to train AI models. The inference providers and model makers that process your requests handle them under their own terms. Our Privacy Policy explains what fal.ai’s terms say about this.
08Acceptable use
You must follow our Acceptable Use Policy, which is part of these Terms. It lists what you cannot create or do with MegaScenes, including content that sexualises minors, intimate images without consent, deepfakes of real people without their consent, and attempts to get around our safety filters.
You also must not copy, scrape or reverse engineer MegaScenes, access it with bots or automated scripts, or resell access to it.
09Suspension and closing your account
You can close your account at any time in Settings, or by writing to us at support@example.com from the email address on your account. We delete your account, your files and your history within 30 days and confirm by email when it is done, except for the records the law requires us to keep, such as payment records. Closing your account deletes your outputs, so download anything you want to keep first. Paid credits exist only as long as your account does: closing the account ends them. If you have unused paid credits, read the Refund Policy before you close it.
We can suspend or close your account if you break these Terms or the Acceptable Use Policy, if your use puts other people or the service at risk, or if the law requires it. We tell you why, unless the law or the safety of others prevents us. If you think we made a mistake, write to us and we will review the decision.
If we close your account, we refund the price of the paid credits you have not used, in proportion to what you paid, to your original payment method. If we close it because of child sexual abuse material, intimate images without consent or payment fraud, we refund only where the law requires it.
10Warranties and liability
We work to keep MegaScenes available and accurate, but we provide it “as is” and “as available”. To the extent the law allows, we do not promise that it will be uninterrupted or error-free, or that outputs will be accurate, original or fit for a particular purpose.
To the extent the law allows, we are not liable for indirect or consequential losses, such as lost profits or lost data, and our total liability to you for any claim is limited to the greater of the amount you paid us in the 12 months before the claim and US$100.
Nothing in these Terms limits liability that cannot be limited by law, such as liability for fraud, for death or personal injury caused by negligence, or your mandatory rights as a consumer, including your rights if the service is faulty or not as described.
If someone makes a claim against us because of content you submitted, or because you used outputs in breach of these Terms, you are responsible for that claim to the extent the law allows.
11Changes to these Terms
We may update these Terms when the service or the law changes. If a change matters to you, we tell you by email or in the app at least 30 days before it takes effect. If you do not agree, you can cancel and close your account before then. Changes never apply to purchases you made before they take effect.
12Governing law and disputes
These Terms are governed by the laws of the State of Wyoming, USA, without regard to its conflict-of-law rules.
If you are a consumer in the European Union, the European Economic Area or the United Kingdom, you also keep the protection of the mandatory consumer laws of the country where you live, and you can bring a claim in the courts of that country.
If something goes wrong, please write to us first at support@example.com. Most problems can be solved quickly that way. If we cannot solve it together, disputes will be decided by the state or federal courts located in Wyoming, USA, unless the law of the country where you live as a consumer gives you the right to go to your local courts.
